The Town\u2019s policies on land division can be found in the Town\u2019s <a href=\"http:\/\/www.perry-wi.gov\/wp-content\/uploads\/2015\/12\/Town-of-Perry-Land-Use-Plan-approved-2005.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Land Use Plan<\/a><\/span><span style=\"font-weight: 400;\">\u00a0and <a href=\"http:\/\/www.perry-wi.gov\/wp-content\/uploads\/2015\/12\/Land-Division-Ordinance.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Land Division Ordinance<\/a><\/span><span style=\"font-weight: 400;\">. The County\u2019s policies can be found in its Land Division Regulations. Be aware that is possible to receive a land division that creates a parcel of land that will not meet the requirements for a building or driveway permit. The Land Use Plan and the Land Division Ordinance require that a proposed land division preserve, and not interfere, with productive farmland and will not conflict with other goals and policies set forth in the Town of Perry Land Use Plan or Land Division Ordinance. Any request that conflicts with this requirement may be denied.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If a land division creates a parcel between 35 and 80 acres, a certified survey will be required. If a certified survey is required, the Town\u2019s approval will be contingent upon compliance with the instructions in the Land Division Ordinance on \u201cDivision by Certified Survey.\u201d Building sites must be shown on the certified survey.<\/span><\/p>\n<p><b>Step 1: \u00a0Apply<\/b><\/p>\n<p><span style=\"font-weight: 400;\">* Applicants should begin the process with Dane County at the same time as with the Town. \u00a0Information on land division is available on the Dane County Planning &amp; Development website, in the section titled,\u00a0<a href=\"https:\/\/plandev.countyofdane.com\/Zoning\" target=\"_blank\" rel=\"noopener\">Zoning Division<\/a>.<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Complete a <a href=\"https:\/\/www.perry-wi.gov\/wp-content\/uploads\/2019\/10\/Permit-Application-form-revised-2019.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Permit Application<\/a><\/span><i><span style=\"font-weight: 400;\">,<\/span><\/i><span style=\"font-weight: 400;\"> selecting \u201cLand Division.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Obtain the following exhibits:<\/span>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Plat Map <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Aerial photo\/site analysis <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Soil\/slope analysis <\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Site plan (if applicable)<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<ol start=\"3\">\n<li><span style=\"font-weight: 400;\"> Submit the completed Permit Application (<\/span><i><span style=\"font-weight: 400;\">include<\/span><\/i> <strong><i>original <\/i>+ <\/strong><i><span style=\"font-weight: 400;\"><strong>8 copies<\/strong> of the application and each exhibit)<\/span><\/i><span style=\"font-weight: 400;\"> and <strong>fee of $550<\/strong> to the Town Deputy Clerk, Stephanie Zwettler at 9730 County Rd A, Mount Horeb, WI \u00a053572. \u00a0Email questions to: \u00a0<a href=\"mailto:sszwettler@gmail.com\">sszwettler@gmail.com<\/a>\u00a0\u00a0<\/span><\/li>\n<li>Proceed to Step 2 outlined below.<\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n<p><i><span style=\"font-weight: 400;\">Note: \u00a0If applying for\u00a0<strong>multiple\u00a0land divisions or zoning changes<\/strong> <strong>at the same time,<\/strong> only one application fee is necessary: \u00a0<span style=\"text-decoration: underline;\">they can all be combined under a single deposit of $550<\/span>. \u00a0However, if they are submitted at different times, a deposit will be charged each time.\u00a0\u00a0Applications requiring only one site view for approval may be eligible for up to 50% refund of this fee. \u00a0However, applications that result in more than one site view will require an additional fee of $250.00 per site visit. \u00a0<\/span><\/i><\/p>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3 style=\"text-align: center;\"><span style=\"text-decoration: underline;\"><b>ZONING CHANGE<\/b><\/span><\/h3>\n<p><span style=\"font-weight: 400;\">Zoning changes usually involve a change from one zoning district to another zoning district. A change in the type of use allowed within an existing district a Conditional Use Permit (CUP) must be requested. Decisions on requests for zoning changes in the Town of Perry are made jointly by the Town of Perry and Dane County. Such requests must be consistent with the policies of both government units. The Town\u2019s policies can be found in the Town\u2019s <a href=\"https:\/\/www.perry-wi.gov\/wp-content\/uploads\/2020\/02\/Town-of-Perry-Land-Use-Plan-approved-2005.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Land Use Plan<\/a><\/span><i><span style=\"font-weight: 400;\">.<\/span><\/i><span style=\"font-weight: 400;\">\u00a0 <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The County\u2019s policies on rezoning can be found on Dane County&#8217;s Planning &amp; Development website, in the section titled, \u00a0<\/span><a href=\"https:\/\/plandev.countyofdane.com\/Zoning\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Zoning Division<\/span><\/a><span style=\"font-weight: 400;\">. This letter will be sent by certified mail to all adjoining landowners at least 10 days prior to the Land Use Committee\u2019s regularly scheduled monthly meeting. The notification letter states the intended land use change, the date of the scheduled site viewing by the Land Use Committee and of the impending public hearing at the next regularly scheduled meeting of that committee.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: left;\"><b>Step 3: \u00a0At the Site View<\/b><b><br \/>\n<\/b><\/p>\n<p><span style=\"font-weight: 400;\">It is necessary that you or your agent attend both the site viewing and the public hearing. \u00a0Failure to do so could result in a recommendation for denial or postponement of your application if there are questions that cannot be answered. <\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">Sites must be field-staked<\/span><\/i><span style=\"font-weight: 400;\">. \u00a0Site views are held on the Saturday prior to the Land Use Committee meeting. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It is possible that it might take more than one viewing and\/or public hearing to resolve any concerns that might arise.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: left;\"><b>Step 4: \u00a0At the Land Use Committee Meeting<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Land Use Committee holds a meeting, usually the first Wednesday evening of the month, after the site view. \u00a0It is a public hearing to allow the applicant to present his\/her intentions for the land division or zoning change. It is also the opportunity for neighbors and other residents of the community to express their concerns or questions and to present other pertinent information to the Committee. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After careful consideration of the request, its conformity with the Land Use Plan and the Land Division Ordinance or Zoning Change Ordinance, and other information presented, the Land Use Committee will recommend approval, conditional approval, denial, or tabling to allow time to gather additional information. This decision will be forwarded to the Town Board.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><b>Step 5: \u00a0At the Town Board Meeting<\/b><\/p>\n<p><span style=\"font-weight: 400;\">The Town Board will then consider the application at its next scheduled meeting only if a recommendation has been made by the Land Use Committee. The Town Board usually meets on the <\/span><span style=\"font-weight: 400;\">second Tuesday<\/span><span style=\"font-weight: 400;\"> of the month. Unless your appearance is requested to answer questions, you do not need to attend this meeting. However, if you choose to attend, be advised that this meeting is not a second public hearing, and your input should be limited to new information only. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><\/p>\n<p><span style=\"font-weight: 400;\">After consideration, the Board will approve, conditionally approve, or deny your request.
